Acknowledgement of Risk, Waiver of Liability, and Release Agreement
This Agreement is made between the undersigned participant (or the parent/guardian of a participant) and Sarnia School of Archery / 1000303524 Ontario Inc, hereinafter referred to as "Sarnia Archery."
In consideration of being permitted to participate in any activities offered, use of Sarnia Archery’s facilities, equipment, and receive instruction (collectively, the "Activities"), the undersigned acknowledges, agrees, and understands as follows:
ACKNOWLEDGEMENT OF RISKS
I understand that Archery, Nerf Battles, Gel Blasters, and Combat Archery are inherently dangerous activities that can involve a significant risk of physical injury, disability, paralysis, or death, and/or damage to or loss of property. These risks include, but are not limited to:
- The risk of being struck by a misfired or ricocheting arrow,
- The risk of being struck by a Nerf ball, or Gel Blaster projectile, or Foam Tipped Arrow.
- The risk of injury from faulty or improperly used equipment (bows, arrows, targets, etc.).
- The risk of injury from tripping, falling, or other accidents on the range premises.
- The risk of injury from the actions or negligence of other participants.
- The risk of muscle strains, sprains, concussions, or other physical injuries.
- The risk of exposure to or contraction of infectious diseases, including but not limited to COVID-19, influenza, or viruses, while on the premises.
I voluntarily and freely assume all such risks, both known and unknown, and all responsibility for any loss, cost, damage, and/or personal injury (including death) that I or the undersigned may sustain while participating.
WAIVER AND RELEASE OF LIABILITY
For myself, my heirs, executors, administrators, and assigns, I hereby WAIVE, RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Sarnia Archery, its owners, officers, employees, volunteers, agents, and representatives (collectively, the "Releasees") from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are resulting from my participation in the Activities or my presence on the premises , including any injury, death, or property damage, caused by the NEGLIGENCE, breach of contract, or breach of any statutory duty of care of the Releasees or otherwise.
INDEMNIFICATION
I agree to INDEMNIFY, SAVE, and HOLD HARMLESS the Releasees from any loss, liability, damage, costs, or expenses (including but not limited to legal fees and court costs) that they may incur due to my participation in the Activities, whether caused by my own negligence or otherwise.
RESPONSIBILITY, HEALTH & SAFETY
I certify that I am in good physical condition, have no medical restrictions, and am not under the influence of alcohol or drugs. I agree to follow all safety rules (failure to do so results in removal without refund). In the event of an injury or illness, I authorize Sarnia Archery and its staff to secure medical treatment or arrange transportation if, in their opinion, such action is necessary. I agree to assume all costs related to such medical treatment and transportation, and release Sarnia Archery from any liability related to the provision of emergency medical aid.
CONTINUING AGREEMENT
I agree that this waiver shall be effective and binding upon my family, heirs, executors, and assigns, and shall apply to all activities, currently existing or hereafter devised, in which I participate at Sarnia Archery during the current session or membership period.
SEVERABILITY
I agree that if any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of laws provisions. Any legal action or proceeding relating to this Agreement shall be brought exclusively in the courts of the Province of Ontario.
DECLARATION OF UNDERSTANDING AND ACKNOWLEDGEMENT
By checking a box below and signing this document, I acknowledge the following:
- I have carefully read this entire Agreement.
- I understand the legal rights that I am waiving by signing this Agreement.
- I understand the risks involved in the Activities as described
- I am signing this Agreement voluntarily and freely, without any inducement, coercion, or duress.
- I am fully competent to understand this Agreement.
Refund & Cancellation Policies
- Cancellation of classes prior to 7 days of session: Amount paid less $50 per person registration fee refund plus any transaction fees (e-transfer banking fees and/or point of sales fees incurred by SSA from Square Inc).
- Cancellation/Withdrawal of classes after start date: Refund amount of classes based on rate paid at registration (any applied discounts or promotions applied), less non-refundable $50 registration fee, plus any transaction fees (e-transfer banking fees and/or point of sales fees incurred by SSA from Square Inc).
$115 Class Fee + $50 Registration Fee
Every person is subject to the non-refundable $50 Registration Fee
Parties or Events
$50 Deposit non-refundable. Cancellations less than 24 hour notice will be billed 50% of total invoice. Withdrawal or removal of any person will result in forfeiture of any fees paid. Parties and events may be rescheduled based on availability.
Equipment
No refunds or Exchanges on: Bows, Bow Parts, Bow Accessories Arrows, including but not limited to strings, rests, sights, mechanical releases, limbs, risers,cams or modules. Manufacturers defects exemption within 7 days of purchase.
Make-Up Classes are a Courtesy Offered By SSA
All make-up classes must be done within the session the missed class(s) occurred. Make-ups can not be carried over or transferred to any other session or person.
